Rental Terms & Conditions

1. Deposits

Any individual or company wishing to rent equipment from Image One Camera & Video must present a valid driver's license and a major credit card. No checks are accepted for deposit — no exceptions. The deposit amount varies depending on the equipment being rented, and can be as low as a typical minimum repair estimate or as much as the full retail replacement cost of the equipment.

For credit card customers, the deposit is authorized to the credit card at the time of equipment pickup and refunded upon return of the equipment in like condition. If the customer fails to return the equipment, the customer consents to Image One charging the customer's credit card for the full current retail value of the equipment that needs to be replaced.

2. Equipment Charges & Rental Period

Equipment rental fees and the rental period are computed on a daily basis only, as set forth on your reservation invoice. There are no half-day or hourly rates.

Rentals picked up before 12:00 p.m. (noon) are due back the following business day before 12:00 p.m. (noon). Rentals picked up after 12:00 p.m. (noon) are due back the following day one hour prior to close of business. Weekends have a special 1-day rental rate for equipment picked up after 12:00 p.m. (noon) on Friday and returned before 12:00 p.m. (noon) the following Monday.

3. Loss, Theft, or Damage and Insurance

The customer is liable for any loss, theft, or damage to the rental equipment, and shall at all times be liable to Image One for replacement or repair costs, in addition to accrued rental charges, until Image One is reimbursed for the full replacement value of any equipment lost, stolen, or damaged.

When equipment is not returned in the same condition that it left Image One, the replacement value of the rented equipment is the full list price at the time of replacement. Customers must notify Image One at the time of rental of any defects or damage to the equipment to be rented. If the customer fails to notify Image One of any damage, the customer accepts responsibility for repair of that damage and any associated costs.

In the event the customer is damaged or injured by operation of the equipment, including any equipment malfunction, the customer waives any and all rights to seek recovery of those damages from Image One. Image One is not responsible for any lost or unrecoverable information related to the failure of any equipment, and no claim may be made for collateral or consequential damages.

4. Rental Disclaimer

Image One neither makes nor shall be deemed to have made any warranty or representation, express or implied, concerning the equipment, including without limitation any warranty or representation as to the design, quality, or condition of the equipment, or as to the merchantability or fitness of the equipment for any particular purpose. The customer has selected the equipment on the basis of their own judgment and disclaims reliance upon any statements, representations, or warranties by Image One.

5. Indemnity and Defense

The customer agrees to defend, indemnify, and hold Image One harmless from any claims made against Image One or the customer, their agents, family members, contractors, subsidiaries, or related persons or entities, arising in any way out of the customer's operation of the rented equipment, regardless of who is ultimately found to be at fault. In the event of litigation arising out of this agreement or the circumstances surrounding it, the prevailing party shall be entitled to recover reasonable attorney fees and costs.

6. Battery Policy

Image One is not responsible for battery failure. If an equipment battery fails, there will be no discount on the rental. The customer is responsible for their own back-up batteries, which are available for purchase at Image One.

7. Cancellations and Rental Performance

Image One reserves the right to charge a setup fee for orders canceled within 24 hours of the scheduled pickup time. The customer is responsible for carefully inspecting and testing all equipment prior to accepting it for rent. In the event of equipment malfunction, the customer remains responsible for all rental charges and repair or replacement costs.

Image One is not liable for loss, damage, or injury due to defective equipment. The customer has sole responsibility for confirming they have all necessary equipment to do the job before leaving the store, and Image One is not responsible for the customer's lack of knowledge in the operation of the rented equipment. There are no refunds on rentals once equipment has been taken. No exceptions.

8. Severability

In case any one or more of the provisions contained in this agreement are invalid, illegal, or unenforceable in any respect, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired thereby.

9. Credit Card Authorization

By accepting these terms, the customer authorizes Image One to prepare and submit credit card charge slips using deposits and any of the charge cards on file to recover all charges and other unpaid amounts due for: (a) failure to return the rented equipment; (b) damage to returned rented equipment; and (c) other unpaid charges such as extended rental fees, returned-check costs, and the maximum lawful charge for reasonable legal fees.
